Church not working within the law, says gay priest who lost discrimination claim

An employment tribunal panel ruled on Wednesday that Canon Jeremy Pemberton, who was prevented from taking up a post as a hospital chaplain, was not discriminated against by a former acting bishop of Southwell and Nottingham.

The panel also dismissed a claim of harassment made by Canon Jeremy Pemberton against the former acting bishop, Richard Inwood.

Mr Pemberton had his permission to officiate revoked after marrying his partner in April 2014 and alleged that the Church of England's stance on same-sex marriage breached the 2010 Equality Act.

But the tribunal found the Church had a right to refuse him the job because of his gay marriage and that the State could not impose same sex unions upon the Church.

Speaking on Premier's News Hour he said: "The Church of England comes under the law of the country, so the notion that the Church ought to have a free pass to behave how it choses over matters like this is very wrong.

"We are a Church by law established and we ought to be working and operating within the law of the land."

He added that the issue of how the Church treats LGBT people was "an area of serious anxiety".

Speaking about bringing his tribunal he said it wasn't something he wanted to do: "In the end it was something I felt I had to do.

"So, it wasn't done lightly and it was done thoughtfully and prayerfully and as a conscientious decision."

He said what was done to him was "both wrong and unjust" and that there wasn't "much remedy to be had inside the Church".

Meanwhile a former Labour government minister has criticised the Church of England for "persecuting" Mr Pemberton.

Ben Bradshaw attacked the ruling and the way in which the Church of England had conducted itself.

The Labour MP for Exeter asked Caroline Spelman MP, representing the Church Commissioners, how much money the Church had spent on the employment tribunal.

Ms Spelman said she was unable to answer because "this is still litigation in progress" and the claimant could appeal against the decision.

Mr Bradshaw told the House of Commons: "I very much hope he does appeal.

"Do we not have a right as members of the Church of England to know exactly how much our church has spent in our name to persecute this excellent priest who has been stopped from being a hospital chaplain, a job by all accounts he did superbly, because of the discriminatory approach of the Church of England, particularly when we are celebrating the election in a democratic election of the first openly gay married priest to the General Synod?

"It is a ridiculous situation."

Ms Spelman replied: "This is still litigation in progress and therefore at the moment there is no definitive sum that I can make transparent in the House."

A spokesperson for the Diocese of Southwell & Nottingham said: "We are thankful to the tribunal for its work on this complex case and for its findings in favour of the former Acting Diocesan Bishop, the Rt Revd Richard Inwood, on all the claims made against him.

"We recognise that it has been a long and difficult process for all concerned, and we continue to hold them in our thoughts and prayers.

"Churches across the diocese continue to offer a generous welcome to people from all backgrounds. We remain engaged in the on-going shared conversations across the wider Church of England that are exploring questions relating to human sexuality."
