Judge calls for online divorces

In a review sent to lawyers, Sir James Munby also wrote that the divorce process should be separated from a couple's disputes over money.

The judge said the proposed reform would alleviate the administrative pressure within the family court.

He wrote: "Has the time not come to bring about a complete de-linking - separation - of divorce and 'money so that they are started and pursued by completely separate processes, albeit, of course, that the timeline for ancillary relief is determined by the progress of the divorce? My view, which I have been propounding for some time, is an unequivocal and emphatic yes!"

Harry Benson, a Christians who works at the Marriage Foundation told Premier's News Hour it was hard to argue with Sir James.

He said: "Divorce can certainly provide a speed bump in the road and it should be a non-trivial process but there's no particular need to make it a great big obstacle because splitting up is a tough thing to do for anybody anyway, so I don't actually wildly disagree with this".

Divorce rates have been steadily declining and Benson said he doesn't think online divorce would reverse the trend.

He added: "Divorce rates are much lower and yet the law hasn't changed during that time. So something is happening differently today than was happening say 20-25 years ago and the reality is people who are getting married today are more serious about it."

Lawyers have also backed Munby's idea. Catherine Thomas, managing director of specialist family law firm Vardags, has complained of form-filling and said estranged couples get a poor service.

She said: "The current procedure for applying for a divorce is outdated, inconvenient and expensive.

"The slow bureaucracy of our family courts produces poor value for the taxpayer. A move online would streamline this immensely."
