UK courts "less respectful" of Christianity, says top judge

Britain's most senior female judge says it's not difficult to see why Christians feel they're unfairly treated by the legal system.

Baroness Hale of Richmond, who's deputy president of the Supreme Court in the UK, was speaking in a lecture at Yale Law School in America.

She was addressing the clash of equality rights in Britain following a number of cases where Christians have claimed to have suffered religious discrimination in the workplace but have lost in the courts.

Lady Hale said: "It is not difficult to see why the Christians feel that their religious beliefs are not being sufficiently respected.

"Other religions with stricter dress codes or dietary laws are demanding concessions which Christians feel that it is harder to claim because they cannot point to equivalent religious requirements."

Her comments were debated on the News Hour when Premier's Des Busteed spoke with Andrew Marsh from the campaign group Christian Concern, and the writer and Christian and campaigner Symon Hill.

In Lady Hale's speech she referred to a number of cases which have come to light in recent years.

In January last year the European Court of Human Rights gave its verdict on four Christians with only one getting any success.

Shirley Chaplin, a nurse from Devon, was taken off her hospital ward because she refused to take off a cross at work but the courts deemed health and safety came first.

Gary McFarlane, a relationships counsellor from Bristol, lost his job at Relate after refusing to give sex therapy to gay couples and was told he was breach of contract.

Lillian Ladele, a marriage registrar from London, also lost her job at Islington town hall in north London, after saying her beliefs meant she could not officiate at civil partnership ceremonies.

All three cases lost but it was Nadia Eweida who won her case.

The British Airways check in worker from London had been told she breached the airline's uniform policy by wearing a crucifix.

In January 2013, the court found that her rights had been violated under Article 9 of the European Convention on Human Rights and awarded her damages of €2,000 plus costs of €30,000.

They ruled this as they said British Airways had not reached a fair balance between Eweida's religious beliefs and the company's desire to have a particular corporate image.

Baroness Hale said all the cases were complex and put the rights of one group against another.

She notes that more often than not it's the rights of those with religious opinions that lose out.

She said "It is fascinating that a country with an established Church can be less respectful of religious feelings than one without."

Lady Hale also addressed several cases where Bed & Breakfast owners have turned away same-sex couples wanting to book a double bedroom.

She said the issue is one that needs more discussion and both sides to reach out to the other: "Employers might have to make reasonable accommodation for the right of their employees to manifest their religious beliefs and suppliers of services might have to make reasonable accommodation for the right of their would-be customers to use them."

Lord Carey, the former Archbishop of Canterbury, has welcomed Lady Hale's remarks and has called for the setting up of a "panel of lawyers"  with expertise and a knowledge of religious faith.
